Course details

The Coronavirus Pandemic has had a profound effect on the Irish economy. Economic downturns can result in claims being made against professionals including those engaged in the construction arena.

This webinar will cover the following:

  1. Insurance market trends locally and globally
  2. A discussion on premiums, excess, renewals (answering questions on the renewal form) and how Underwriters assess renewals
  3. The anticipated claims which may be brought against construction professionals based upon experiences of the last economic downturn
  4. A discussion of practical steps which can be taken by construction and design professionals to minimise the risk of future claims
  5. A discussion of terms that should be included or not, in a professional's contractual documentation

There will be a Q&A section at the end of the talk (15mins).

 

Speakers


Sam Moore Partner at Caytons

Sam specialises in professional indemnity claims and policy coverage disputes. His practice is focused on a diverse range of professionals including architects, engineers, insurance brokers and solicitors as well as building contractors. He acts in relation to a wide range of matters from those which are high value and complex to those that are lower value and less complex. He acts in court proceedings as well as at the pre-action stage of claims. He also frequently acts in arbitrations, adjudications and mediations. He is responsible for drafting various professional indemnity policies as well as other policies. Sam’s previous experience includes having worked as a claims handler for another large professional indemnity practice. Sam has a good insight into both insurers’ and insureds’ requirements.  

 

Mary Smith Partner at Caytons

Mary specialises in construction and professional liability disputes, acting for all stakeholders including private clients, professionals, Irish and UK insurers and Lloyd’s syndicates. Recommended in Legal 500 EMEA 2019 for Construction, she regularly acts for professionals (architects, engineers, assigned certifiers, solicitors, financial advisors, estate agents, surveyors and their insurers in a broad range of claims. Mary also provides coverage advice to insurers on policy response issues, has considerable experience in claims investigation and liaising with both Insurers and the Insured on cost-effective claims management.

Mary has significant experience in other forms of dispute resolution, including without prejudice negotiations, conciliation, mediation and arbitration.


Aidan A. Gordon, at Marsh

Appointed FINPRO divisional leader in 2019, Aidan has overall responsibility for the operation and management of the FINPRO client servicing proposition. Prior to his appointment at Marsh, Aidan was Director at JLT Ireland managing the specialist placement and servicing team within the Corporate area. He worked in JLT Ireland from 2001 up to the time JLT were acquired by Marsh in 2018. Areas of Expertise include: Professional Indemnity for all Construction related risks; Financial Institutions Errors & Omissions; Emerging Risks; Employment related Liability and Directors & Officers and Management Liability.
